By accessing or using the EvWorks website and services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our website or use our services. These Terms apply to all visitors, users, and clients of Ev3 Consulting LLC (DBA EvWorks).

EvWorks provides professional marketing services including, but not limited to:

• Web Development: Website design, development, and optimization services
• Ad Management: Digital advertising campaign management across various platforms
• SMS Marketing: Compliant text messaging campaigns and customer engagement programs

Specific service details, deliverables, and pricing are outlined in individual service agreements or proposals provided to clients.

3. Client Responsibilities

As a client of EvWorks, you agree to:

• Provide accurate and complete information necessary for service delivery
• Respond to requests for feedback, approvals, or materials in a timely manner
• Grant necessary access to platforms, accounts, or systems required for service execution
• Ensure all content and materials you provide do not infringe on third-party rights
• Comply with all applicable laws and platform terms of service

4. Payment Terms

• Payment terms are specified in individual service agreements
• Invoices are payable within the timeframe stated on the invoice
• We reserve the right to suspend services for accounts with overdue payments
• All fees are non-refundable unless otherwise specified in writing

For subscription-based services, you authorize us to charge your payment method on a recurring basis until you cancel.

5. Intellectual Property

The EvWorks website, brand, logo, and all proprietary tools, methodologies, and processes remain the exclusive property of Ev3 Consulting LLC. Upon full payment, clients receive ownership or licensing rights to deliverables as specified in individual service agreements.

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of our business relationship.

7. Limitation of Liability

• EvWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim
• We do not guarantee specific results from marketing campaigns

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.

9. SMS Communications

If you opt in to receive SMS messages from Ev3 Consulting LLC (DBA EvWorks), you may receive recurring marketing and informational messages. Message frequency varies. 10. Termination

Either party may terminate a service agreement with 30 days written notice for ongoing/subscription services, or immediately if the other party breaches material terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
